Scope of this Privacy Policy
3. This Privacy Policy applies only to the actions of Grounded Connections Ltd and Users with respect to this Website. It does not extend to any websites that can be accessed from this Website, including, but not limited to, any links we may provide to social media websites.
4. For purposes of the applicable Data Protection Laws, Grounded Connections Ltd is the “data controller”. This means that Grounded Connections Ltd determines the purposes for which, and the manner in which, your Data is processed.
Data Collected
5. We may collect the following Data, which includes personal Data, from you:
- name;
- date of birth;
- gender;
- job title;
- profession;
- contact information such as email addresses and telephone numbers;
- demographic information such as postcode, preferences and interests;
- IP address (automatically collected);
- identification documents, personal values, lifestyle, relationship status, dating history, preferences, payment/billing details;
- information relating to unspent criminal convictions or criminal offences, where you disclose this to us, or where you tell us you have been charged with a criminal offence during your Contract with us;
in each case, in accordance with this Privacy Policy.
6. Where you are a Network Member, we typically collect a more limited set of the above Data — usually your name, photograph, and demographic or lifestyle information relevant to matching — identified by our matchmakers as described below. If and when you become a Client, the fuller Data set at clause 5 above will apply to you, including identity verification.
How We Collect Data
7. We collect Data in the following ways:
- data is given to us by you;
- data is identified or collected by our matchmakers about Network Members; and
- data is collected automatically.
Data That is Given to Us by You
8. Grounded Connections Ltd will collect your Data in a number of ways, for example:
- when you contact us through the Website, by telephone, post, e-mail or through any other means;
- when you register with us and set up an account to receive our products/services;
- when you make payments to us, through this Website or otherwise;
- when you use our services;
in each case, in accordance with this Privacy Policy.
Data Relating to Network Members
9. Where you are identified as a potential Network Member, some of your Data may initially be identified or collected by our matchmakers from publicly available sources, personal referrals, or professional introductions, rather than being given to us directly by you. Before including you in our network, we will contact you directly to confirm your details and your willingness to be considered as a potential match for our Clients.
Data That is Collected Automatically
10. To the extent that you access the Website, we will collect your Data automatically, for example:
- we automatically collect some information about your visit to the Website. This information helps us to make improvements to Website content and navigation, and includes your IP address, the date, times and frequency with which you access the Website and the way you use and interact with its content.
- we will collect your Data automatically via cookies, in line with the cookie settings on your browser. For more information about cookies, and how we use them on the Website, see the section below, headed “Cookies”.
Our Use of Data
11. Any or all of the above Data may be required by us from time to time in order to provide you with the best possible service and experience when using our Website. Specifically, Data may be used by us for the following reasons:
- internal record keeping;
- improvement of our products / services;
- We use the personal information you provide to facilitate personalised introductions and curated date experiences. As part of this process, prior to confirming a match, one of our matchmakers may share a brief bio with the other prospective match, including your first name, age, and a short written description of you (e.g. interests, values, what you’re looking for) to help both parties decide whether to proceed with an introduction. We do not share your photograph, surname, contact details, or any other identifying information with a prospective match at this stage. Introductions remain “blind” in the visual sense: matched members do not see a photo of one another until they choose to meet in person. It is the client’s responsibility to inform Graft Dating / the matchmaker if their name is distinctive or otherwise likely to make them easily identifiable or searchable online, and to indicate whether they would prefer to be referred to by a nickname or alternative name during the matching process. Where no such notice is given, Graft Dating will proceed on the basis that the client’s full name may be used as provided. This limited bio-sharing is necessary for us to provide the matchmaking service itself and is carried out at the discretion of our matchmakers as part of the introduction process described in our Terms and Conditions;
- to build, maintain and offer our Clients access to a broader and higher-quality pool of potential matches (the “Network”), including through the identification, inclusion and periodic review of Network Members;
in each case, in accordance with this Privacy Policy.
12. We may use your Data for the above purposes if we deem it necessary to do so for our legitimate interests. If you are not satisfied with this, you have the right to object in certain circumstances (see the section headed “Your rights” below).
13. When you register with us and set up an account to receive our Services as a Client, the legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.
Network Members
14. Where you are a Network Member, our lawful basis for processing your Data is our legitimate interests in building and maintaining a curated pool of potential matches for our Clients, which is fundamental to how our matchmaking service operates. We have considered that this processing is proportionate and does not override your own interests or fundamental rights and freedoms, given the limited nature of the Data typically involved and your right to object to this processing at any time (see “Your Rights” below).
15. We will keep your Data on file for as long as we reasonably consider you may be a suitable potential match for a Client, and in any event until you ask us to remove it, at which point we will delete your Data in accordance with the “Your Rights” section below.
16. If you become a Client, the provisions of this Privacy Policy applicable to Clients will apply to you from that point, including as to the further Data we collect and our use of it.
Criminal Offence Data
17. Where you disclose to us information relating to unspent criminal convictions or offences — including as described in our Terms and Conditions, or where you tell us you have been charged with a criminal offence during your membership — our lawful basis for processing this Data is your explicit consent. We only use this Data to assess your suitability to take part in our Network and to make decisions about your membership, including any suspension or removal where appropriate.
18. We retain criminal offence Data only for as long as necessary for these purposes, and will delete it when it is no longer needed, save where we are required or permitted to retain it for legal or regulatory reasons.
Conduct, Complaints and Safety Records
19. We may also hold Data relating to any complaint or concern raised about you, or about your conduct towards another Client or Network Member, and any decision we make as a result, including any suspension or removal from our Network. We process this Data on the basis of our legitimate interests in maintaining the safety and integrity of our Network.
20. Where we remove a Client or Network Member from our Network for a safety or conduct-related reason, we will keep a limited record of that decision even if you later ask us to delete your other Data, so that we can maintain the safety and integrity of our Network and avoid re-admitting someone we have previously removed. We do this on the basis of our legitimate interests described above.
Who We Share Data With
21. We may share your Data with the following groups of people for the following reasons:
- our employees, agents and/or professional advisors — to assess suitability for curated introductions;
- prospective matches identified by our matchmakers — limited to your first name, age and a short written bio, to facilitate personalised introductions, as described above;
in each case, in accordance with this Privacy Policy.
Keeping Data Secure
22. We will use technical and organisational measures to safeguard your Data, for example:
- access to your account is controlled by a password and a user name that is unique to you.
- we store your Data on secure servers.
23. Technical and organisational measures include measures to deal with any suspected data breach. If you suspect any misuse or loss or unauthorised access to your Data, please let us know immediately by contacting us via this e-mail address: info@graftdating.com.
24. If you want detailed information from Get Safe Online on how to protect your information and your computers and devices against fraud, identity theft, viruses and many other online problems, please visit www.getsafeonline.org. Get Safe Online is supported by HM Government and leading businesses.
Data Retention
25. Unless a longer retention period is required or permitted by law, or as set out at clause 15 (Network Members), clause 18 (Criminal Offence Data) or clause 20 (Conduct, Complaints and Safety Records) above, we will only hold your Data on our systems for the period necessary to fulfil the purposes outlined in this Privacy Policy or until you request that the Data be deleted.
26. Even if we delete your Data, it may persist on backup or archival media for legal, tax or regulatory purposes.
Your Rights
27. You have the following rights in relation to your Data:
- Right to access — the right to request (i) copies of the information we hold about you at any time, or (ii) that we modify, update or delete such information. If we provide you with access to the information we hold about you, we will not charge you for this, unless your request is “manifestly unfounded or excessive.” Where we are legally permitted to do so, we may refuse your request. If we refuse your request, we will tell you the reasons why.
- Right to correct — the right to have your Data rectified if it is inaccurate or incomplete.
- Right to erase — the right to request that we delete or remove your Data from our systems. This right is not absolute: where your Data forms part of another Client’s or Network Member’s own record of an introduction or match, or where we have a legitimate interest in retaining limited Data as described under “Conduct, Complaints and Safety Records” above, we may not always be able to delete all such Data in full.
- Right to restrict our use of your Data — the right to “block” us from using your Data or limit the way in which we can use it.
- Right to data portability — the right to request that we move, copy or transfer your Data.
- Right to object — the right to object to our use of your Data, including where we use it for our legitimate interests (this is particularly relevant if you are a Network Member — see “Network Members” above).
- Right to complain — the right to raise a complaint with us directly about how we handle your Data.
28. To make enquiries, exercise any of your rights set out above, or withdraw your consent to the processing of your Data (where consent is our legal basis for processing your Data, including in relation to Criminal Offence Data), please contact us via this e-mail address: info@graftdating.com.
29. If you have a complaint about how we handle your Data, please contact us in the first instance via this e-mail address: info@graftdating.com. We will acknowledge your complaint within 30 days, investigate and respond without undue delay and inform you of the outcome.
- If you are not satisfied with the way your complaint is handled by us, you may refer your complaint to the relevant data protection authority. For the UK, this is the Information Commissioner’s Office (ICO). The ICO’s contact details can be found on their website at ico.org.uk.
30. It is important that the Data we hold about you is accurate and current. Please keep us informed if your Data changes during the period for which we hold it.
